Agreement to Terms
Welcome to Hat Trick Local (HTL). These Terms of Service ("Terms") govern your access to and use of the hattricklocal.com website, applications, and services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.
Eligibility
You must be at least 13 years old (or 16 in certain jurisdictions) to use our Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. If you are using the Service on behalf of a club, store, or other organization, you represent that you have authority to bind that organization to these Terms.
User Accounts
To access certain features of the Service, you may need to create an account. When creating an account, you must provide accurate, current, and complete information. You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to disable accounts that violate these Terms.
Social Login and Third-Party Authentication
We offer the option to create an account or sign in using third-party platforms, including:
- Google Sign-In: Authenticate using your Google account
- Apple Sign-In: Authenticate using your Apple account
- Facebook Login: Authenticate using your Facebook account
- TikTok Login: Authenticate using your TikTok account
When you choose to authenticate through these third-party services, you agree to their respective terms of service and privacy policies. We receive limited profile information (such as name, email, and profile picture) from these services solely for account creation and authentication purposes. You can disconnect linked social accounts at any time through your account settings.
Your use of third-party authentication services is subject to: Google Terms of Service, Apple Terms of Service, Facebook Terms of Service, and TikTok Terms of Service.
The availability of social login options does not imply endorsement by these platforms. We are not responsible for the availability, accuracy, or content of these third-party services.
Acceptable Use
You agree to use our Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Attempt to gain unauthorized access to any part of the Service, other accounts, or computer systems
- Use the Service in any way that could damage, disable, or impair the Service or interfere with other users
- Violate any applicable local, state, national, or international law or regulation
- Transmit any unsolicited advertising, promotional materials, or spam
- Upload or transmit viruses, malware, or other malicious code
- Use automated means (bots, scrapers, etc.) to access the Service without our written permission
- Misrepresent your identity or your authority to act on behalf of a club, store, or organization
We reserve the right to suspend or terminate accounts that violate these terms without prior notice.
Service Content and Data Accuracy
Our Service provides tools for uniform ordering, roster management, jersey number assignment, and club-store coordination. While we strive for accuracy and reliability, the Service depends on data entered by clubs, stores, parents, and administrators. We make no warranties regarding the completeness, reliability, or accuracy of data entered by other users.
You are solely responsible for verifying important details (such as uniform sizes, jersey numbers, order quantities, and pricing) before confirming orders. Clubs and stores are responsible for the accuracy of their own roster data, product catalogs, and pricing.
User-Generated Content
You retain ownership of any content you create, upload, or submit through the Service ("User Content"), including roster data, team configurations, and order information. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content in connection with operating and improving the Service.
You are solely responsible for your User Content and represent that you have all necessary rights to submit it. You agree not to submit content that is illegal, defamatory, obscene, or violates the rights of others.
We reserve the right to remove any User Content that violates these Terms or that we find objectionable, without prior notice.
Third-Party Services and Links
Our Service integrates with and may contain links to third-party websites, services, and content. These include:
- Authentication services (Google, Apple, Facebook, TikTok)
- Authorize.Net and Clover for payment processing
- Analytics services for service improvement
We do not control and are not responsible for third-party content, privacy practices, or terms of service. Your interactions with third-party services are governed by their respective terms and policies. We encourage you to review these before using their services.
Inclusion of links or integration with third-party services does not imply endorsement or recommendation by Hat Trick Local.
Payments and Purchases
Certain features or services may require payment, including uniform orders and registration fees. All payments are processed securely through our payment partners (Authorize.Net and Clover). By making a purchase, you agree to pay all applicable fees and authorize us to charge your chosen payment method. Prices are set by clubs and stores and are subject to change. Refund policies are determined by the club or store fulfilling your order and will be communicated at the time of purchase.
Intellectual Property
The Service and its original content (excluding User Content), features, and functionality are owned by Hat Trick Local and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of our Service or included software, nor may you reverse engineer or attempt to extract the source code, unless permitted by law.
You retain all rights to the User Content you create. However, you grant us a license as described in the User-Generated Content section above.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HAT TRICK LOCAL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
Our total liability for any claims arising from or related to these Terms or the Service shall not exceed the amount you paid us, if any, in the twelve (12) months preceding the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
Indemnification
You agree to indemnify, defend, and hold harmless Hat Trick Local and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney's fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms.
Termination
You may terminate your account at any time by contacting us or using the account deletion feature in your settings. Upon termination, your right to use the Service will immediately cease.
We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms.
Upon termination, provisions of these Terms that by their nature should survive will remain in effect, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.
Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of New York, without regard to its conflict of law provisions.
Any disputes arising from or relating to these Terms or the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent courts of the State of New York.
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Hat Trick Local regarding the Service and supersede any prior agreements or communications.
